NFL Discrimination Lawsuit

Former Miami Dolphins head coach Brian Flores is currently still in the process of suing the NFL for its malpractice in coaching hires.


The NFL in the latest news to this case is seeking to turn the Brian Flores lawsuit from a public hearing to a private arbitrary hearing.


In a civil case management plan and scheduling order submitted by the parties on Thursday, the league and the various teams that have been named in the case express an intention to file a motion to compel arbitration or, in the alternative, a motion to dismiss for failure to state a claim.


Most cases filed against the league, the NFL usually attempts to invoke an arbitration process that typically calls for the issues to be resolved in a private arbitration process resolved by Commissioner Roger Goodell.


The NFL is really pushing for an arbitrary hearing because, now current Defensive assistant coach Brian Flores, is asking for a judicial monitor to be appointed to oversee the NFL’s hiring process. The NFL has rejected the proposal to use mediation with the inclusion of a neutral third party, including retired federal judges and members of the legal and civil rights community to help oversee hiring practices.


While there is a rule in place for the NFL hiring minority coaches, the “Rooney Rule’s” effectiveness is nearly ineffective as it only makes NFL teams interview a minority coach. However, after that there’s not much else it can do.


Any league that does the right thing by its players and has nothing to hide shouldn’t have qualms about defending itself in open, public court against any and all claims. The NFL wants to have every single issue ever made against them to be resolved in a process that is both secret and completely rigged. What does that say about whether the NFL believes the league and its teams does the right thing by its current or former employees?


To some people if this arbitration request goes through it will be another example of the NFL not taking accountability for its continuously discriminatory hiring practices.
